With simple titles like “I Gotta Feeling” and “Boom Boom Pow,” you wouldn’t think that the Black Eyed Peas  copied those tracks from someone else. This much is alleged in two separate copyright infringement lawsuits filed Thursday in the United States District Court for the Central District of California.

In one suit, Texas songwriter Bryan Pringle alleges that the B.E.P. intentionally copied his song “Take a Dive” when they co-wrote and recorded their Grammy award-winning track “I Gotta Feeling.”

The other complaint is a re-filing of a January 2010 federal lawsuit. Chicago artist Ebony Latrice Batts, known as “Phoenix Phenom,” and her producer and co-songwriter, Manfred (Manny) Mohr, accuse the Black Eyed Peas of duplicating their song “Boom Dynamite” when they wrote and recorded their hit song “Boom Boom Pow.”

Dean A. Dickie of Miller Canfield is one of the attorneys representing the plaintiffs. Dickie said, “A simple listening to the songs will expose them as having been copied and being ‘substantially similar’– the legal standard in copyright infringement cases.”

The plaintiffs seek damages, as well as future credits and royalties. Plaintiffs in both suits also seek a permanent injunction against all future singing and distribution of the songs, in the U.S. and worldwide.

If these claims are valid, they would place a cloud of suspicion over two of the Black Eyes Peas’ biggest hits to date. Losing the rights to these songs would leave the group at an impasse. Perhaps they would have to abandon their mainstream success, dismiss Fergie from the group and return to their days as obscure rappers and break-dancers.
